Palestinian PM: Israeli sanctions starting to bite (AP)

RAMALLAH, West Bank ? Palestinian officials said Sunday they won't be able to pay upcoming public-sector salaries that support nearly one-third of Palestinian families in the in the West Bank and Gaza, the clearest sign yet that Israeli economic sanctions are starting to bite.

Israel last month stopped the transfer of tax revenues and other funds it collects on behalf of the Palestinians, retaliation for the Palestinians' successful bid for admission to the United Nations' cultural agency UNESCO, which was part of a larger effort to gain admission as a state in the world body.

Israel says a Palestinian state should be established through negotiations, and it accuses the Palestinians of acting unilaterally to bypass peace talks.

The monthly transfers of about $100 million, along with hundreds of millions of dollars a year in foreign aid, are crucial for keeping the government of Western-backed Palestinian President Mahmoud Abbas afloat.

Abbas' prime minister, Salam Fayyad, said Sunday that he won't be able to pay upcoming salaries, which are due in the first week of December.

He said the continued suspension of the tax transfers "has both an immediate impact on the lives of all employees and their dependents, some 1 million people ... (and) has a devastating indirect impact throughout the whole economy."

The Palestinian Authority is the biggest employer in the Palestinian areas, with tens of thousands of civil servants and security forces.

U.N. Secretary-General Ban Ki-moon, U.S. Secretary of State Hillary Rodham Clinton and Tony Blair, envoy of the Quartet of Mideast mediators have urged Israeli Prime Minister Benjamin Netanyahu to resume the transfers.

An Israeli official said Sunday that Israel suspended the transfers temporarily to express its concern over the conduct of Abbas and his government, mainly his quest for recognition of Palestine.

The Israeli official said Israeli might make decision to withhold the money permanent if Abbas sets up a unity government with Hamas, the Islamic militant group that controls Gaza. The official spoke on condition of anonymity because he was not authorized to discuss the issue with reporters.

A reconciliation agreement between Abbas and Hamas chief Khaled Mashaal calls for an interim unity government that would prepare for May elections, but it appears unlikely it will be formed because of disagreements over who should lead it. Hamas strongly opposes Abbas' candidate for the job, the West Bank-based Fayyad, who is popular with Western donors.

A senior Hamas figure said Abbas and Mashaal quietly agreed in a meeting last week to keep their separate governments in place until elections. Abbas told Mashaal that the two-government status quo was "convenient for both sides and any change might be costly," according to the Hamas figure. who spoke on condition of anonymity because the leaders did not make their decision public.

Abbas envoy Azzam al-Ahmed denied there was a quiet agreement on shelving the interim unity government and insisted there is "no possibility of holding elections without a unity government."

Keeping the existing governments in place would help Abbas avoid a Western backlash and continue the flow of international aid to his government. Western powers fear a unity government, even one composed of technocrats without clear political affiliations, would be heavily influenced by Hamas, which is not internationally recognized.

Top Hamas official Moussa Abu Marzouk said that it was at least possible to skip an interim government and head straight to elections. The Hamas statements suggested that a solution was being finessed to get around the disagreement over keeping Fayyad.

Also Sunday, Gaza farmers began the seasonal export of produce to Europe.

Israel has banned most exports from Gaza since Hamas seized the territory, but has permitted seasonal shipments of strawberries, cut flowers and other agricultural goods.

A truckload of strawberries left Gaza to launch the season, which is to run through May.

The number of exports is well above last year's levels.

Before the Hamas takeover, 85 percent of Gaza's outgoing goods were sold in Israel and the West Bank, according to Gisha, an Israeli human rights group that lobbies on behalf of easing Palestinian travel restrictions.

According to Gisha's statistics, about 83 percent of Gaza's factories are idle or operating at 50 percent or less capacity. Unemployment is officially listed at 28 percent.

Video shows alleged abuse by Mexican police (AP)

MEXICO CITY ? Mexico City's police chief says he has launched an investigation into a journalist's video that allegedly captures a police officer abusing a suspect.

Milenio Television reported Friday that one of its reporters had taken the video recording an officer repeatedly pushing the man's head into a bucket of water while his T-shirt was pulled up over his head and face.

The alleged abuse took place following a gunfight between police and gunmen in the working-class neighborhood of Tepito. The video's authenticity could not be independently confirmed, and neither Milenio nor police released the suspect's identity.

Mexico City Public Safety Director Manuel Mondragon said Friday that he was outraged by the video and that both the police and local prosecutor will look into it.

Survey: iPhone owners most loyal to brand among mobile users (Digital Trends)

When it comes to brand loyalty in the smartphone market, Apple appears to be ahead of the pack. According to the results of a survey by research firm GfK, 84 percent of iPhone owners said they would choose another iPhone when they next replace their smartphone.

Among users of phones powered by Google?s Android operating system, 60 percent said they would stay with a phone using the same software.

Brand loyalty was weaker among BlackBerry users, with only 48 percent saying they would likely stick with one of Research In Motion?s devices. Last month the Canadian company had a torrid time of it, together with users of its smartphones, when its communication network suffered a three-day outage.

With 63 percent of consumers saying they will keep with the kind of phone that they currently own, it?s clearly getting more and more difficult for rival brands to elbow their way in. Of course, there are still opportunities ? if a company came out with a real head-turner of a product, it would undoubtedly shake up the market and put a consumer?s loyalty to the test.

Also, GfK analyst Ryan Garner suggests ?the richest rewards will go to those providers that can create the most harmonious user experience.?

For many people, Apple?s success can be attributed to clever marketing that encouraged consumers to make an emotional connection with its products. On top of that, the company got in early with the iPhone. It may not have been the first smartphone on the market, but for many consumers it was the first one that was actually smart. They lapped it up, and continue to do so, with more than four million units of the Cupertino company?s latest version of the device, the iPhone 4S, selling on its opening weekend last month.

But companies know they can?t rest on their laurels when it comes to loyalty. Slip behind the field in coming up with innovative ideas and groundbreaking products, or mess up badly with your service, and consumers will start looking elsewhere.

For its survey, GfK questioned approximately 4,500 people in Britain, France, Germany, Italy, Spain, Brazil, China, the United States and Japan.

Black Friday Shopping: 8 Tips To Curb Overspending

Do you get a rush when you purchase something? When you swipe your credit card, use the stylus to hit "yes" on the machine, and then take your just-bought treasures in a glossy paper bag from the store clerk?

Scientifically, it's no surprise that we get this rush -- just like with any other pleasurable activity, shopping can spur the release of feel-good hormones in our brains, said Dr. James A. Roberts, Ph.D., a marketing professor and consumer culture expert at Baylor University and author of "Shiny Objects: Why We Spend Money We Don't Have in Search of Happiness We Can't Buy" (HarperOne, 2011).

"We used to think that [addiction comes] only [from] chemicals," Roberts told HuffPost. "We thought it had to be nicotine, alcohol, but we're finding that anything that produces pleasure in your brain has the potential to be addictive."

And for Black Friday in particular, our "getting while the getting is good" mentalities are activated, said Dr. April Lane Benson, Ph.D., a psychologist, expert in treating compulsive buying disorder, and author of "To Buy or Not to Buy: Why We Overshop" (Trumpeter, 2008).

"Whether we need something or not, the thrill of the hunt, the excitement of getting the best deal, the idea that someone else may be getting it and then we'll lose out are all operative here," Benson told HuffPost. "We also like the idea that we've got our shopping done early ... but in so many cases, the Black Friday shopping just releases the logjam and gives us license to keep on spending until the doors finally close on Christmas Eve."

Losing self-control when it comes to shopping can lead to debt and other financial ruin. Whether you are a full-blown shopping addict or you just have a hard time resisting a good deal, here are some tips for keeping your overspending and overbuying in check this Black Friday, the holiest of shopping holidays.

Skip The Sales Altogether

1?of?10

If you skip Black Friday shopping altogether, you won't be tempted to make impulse purchases, Roberts said. "Everyone has their opinions, but generally you'll find as good of deals on Cyber Monday, or even after," he said. If you know that you have a shopping problem -- or even if you're not a full-blown shopping addict, but maybe you enjoy spending a little too much -- it's best to stay away from stores on Friday, he said. The stimulation from the sale signs and colorful merchandise give off the sense of novelty and pleasure, which makes spending that much more tempting. "You're spending money, throwing credit cards down, having lunch, hanging out with friends and family, all the sights and sounds -- it's an exciting time," Roberts said. "So the best thing you can do is just to avoid it." In that same vein, Roberts suggests opting for another family-centered activity to keep your mind off of the missed sales.

?Personal Finance Experts? vs ?Personal Finance Bloggers?: Who ...

By Ginger on November 24th, 2011

Did you catch CNN Money this afternoon?? Or what about the latest financial expert featured on Oprah?? Did their advice speak to your situation, personally?

Good, I didn?t think so either.

One of the issues I take with some of the ?personal finance experts? out there today is that none of the advice is truly personal. Their approach is often too generalized because they are catering to a large audience which means they lack true accessibility to people that need personalized advice.

We Need More Coaches (real people), Not Experts

Experts tend to preach and throw the advice at the people receiving it without any consideration for the individual situation they speak about.? Every one?s situation is different, right?? So why do we flock to experts? Rarely are they able speak to our lives the way someone who had the time to sit down and review our situation would.

Over the summer, I had an opportunity to sit and meet with a financial coach who reviewed my situation personally gave me advice based on my situation.? That?s something I really needed because my situation, is just that-my situation.? After spending what seemed like years sifting through certified financial planners who only wanted to set me up with the next best fee based investment account, I gave up.? They just didn?t get it.? I needed someone who got me and it was truly the best decision that I made for myself and for my finances.

Personal Finance Bloggers vs Personal Finance Experts

Recently, a ?personal finance expert? confessed to me that she doesn?t mingle with personal finance bloggers since they dilute her message and dance in her space.? She felt this was a threat to her brand being that we essentially discuss the same issues.? Looking at her social media profiles, I could easily see why.? She spent more time promoting herself and ?her brand?, rather than finding a way to intimately communicate with her audience about their financial issues.

This is something I have always taken issue with and just one of the reasons why I started this blog.? While Suze Orman is someone I?ve admired since the age of 11, I wanted to lend a more personal voice to the personal finance blogosphere.? Where these experts often miss the mark is they spend too much time talking at and preaching to their audience while never sharing much of their own experiences.

One of the reasons why personal finance bloggers are so popular (IMHO) is that readers are able to connect with them because we are just like you.? We talk about our daily struggles because we aren?t perfect. Some of us even tell our readers how much debt we owe, savings in the bank and what we spent this past weekend.

That?s what people want to see.? Experiences which look like theirs, not another book with regurgitated and refashioned financial advice like ?save more? and ?spend less?.? My advice to the experts?? Get real with your audience and help them see that you?ve been in their shoes while addressing their situations personally.

Become Your Own Money Expert

One of the things I value since starting this blog is the awareness about myself and the things I?ve learned along the way based on my own experience.? I don?t need Suze yelling at me telling me how silly I am for wanting to take that trip to Costa Rica because I am in debt.? I also don?t need a financial website for women to tell me about my money in intellectually insulting lipstick chatter while selling me blushes and blowing me kisses.? I want it straight with no chaser.? And, I think the best place to get it is through my own experience while sharing it with others.

You already have the answers, don?t wait for a ?personal finance expert? to be the ?be and end all? for your finances.? It doesn?t take an Ivy League MBA to help us understand why we should spend less and save more.?? Sure, you may pick up one of their books to learn the basics but everything else is basically about your experience and the lessons learned from it.

What are your thoughts?? Who are you listening to and why?? Do personal finance experts have your attention?

NASA's Massive Curiosity Rover Nears Launch toward Mars

News | Space

The rover formerly known as the Mars Science Laboratory should tackle some of the biggest questions about Mars?assuming it can survive an elaborate touchdown

Mars Science LaboratorySTANDING TALL: NASA's giant Curiosity rover should reach the surface of Mars in August 2012. Image: NASA/JPL-Caltech

Don't be fooled by the innocuous name?Curiosity,?NASA's new Mars rover, is a brute.

Curiosity, which is slated to launch Saturday morning on an Atlas 5 rocket from Cape Canaveral Air Force Station in Florida, is the biggest planetary rover ever built. The six-wheel-drive robot is three meters long?longer than a Smart ForTwo mini car?and its headlike mast rises 2.1 meters above the ground. With a suite of 10 science instruments, Curiosity weighs in at nearly 900 kilograms, more than NASA's last three Mars rovers combined. [Read more about Mars exploration in this special report.]

To put its size in perspective, consider that Curiosity is scheduled to touch down in August 2012, just over 15 years after NASA's first Mars rover began exploring the Red Planet. That rover, Sojourner, stood about 30 centimeters high. Curiosity is designed to roll over obstacles twice that tall.

But brute force is not everything?it's what's inside that counts. "We have our generic bigger and better answer" for what is new about the $2.5-billion Curiosity, says John Grotzinger, a planetary geologist at the California Institute of Technology and the NASA Jet Propulsion Laboratory in Pasadena, Calif. Grotzinger, the mission's project scientist, notes that the rover's technology is simply superior to that of its predecessors?the cameras have better resolution, for instance, and can take high-definition video.

And unlike its predecessors, Curiosity will not depend on sunlight to carry out its mission. Instead its power will come from a radioisotope thermoelectric generator?a 4.8-kilogram supply of radioactive plutonium 238 that decays to produce heat. Devices called thermocouples turn some of that heat into electricity, providing about 110 watts to the rover. (The heat also keeps the rover's systems warm enough to function.) Plutonium 238 has a half-life of more than 80 years, so Curiosity may be able to exceed its 23-month nominal mission lifetime by several years.

But the real key to Curiosity's capabilities are two instruments that can make definitive chemical analyses of what the Red Planet is made of. "This is a mobile chemistry laboratory," Grotzinger says. In fact, the Curiosity moniker came along only in 2009, when a Kansas sixth grader named Clara Ma won a naming contest. Prior to that, the mission was known more straightforwardly as the Mars Science Laboratory. The rover's chemical analyses should dig into what Mars was like billions of years ago, when it was wetter and could have featured niches conducive to life.

The two key geology instruments, an x-ray diffraction unit and a multipurpose sample-analysis system, will be fed by a robotic arm that can scoop up soil or drill into a rock to collect a powdered sample from the interior. The x-ray diffraction instrument will aim a beam of x-rays at samples to reveal their structure and composition, making possible definitive identifications of specific minerals. The sample-analysis instruments, on the other hand, can taste the composition of the surrounding atmosphere or heat solid samples to 1,000 degrees Celsius to release trace compounds within.

With its chemistry tools, Curiosity may help shed some light on all-important methane. Some research indicates that methane, a molecule that has mainly biological origins on Earth, is seeping from Mars in plumes that hint at ongoing geologic?or possibly even biological?activity there. If Curiosity encounters methane in the atmosphere, the rover can make isotopic analyses of the gas to help determine the methane's origin.

SAN DIEGO (AP) ? A man accused of trying to rob a San Diego 7-Eleven while dressed as Gumby has pleaded guilty to misdemeanor burglary.

A lawyer for 19-year-old Jacob Kiss entered the plea Wednesday. Kiss' accomplice, 20-year-old Jason Giramma, also pleaded to the same charge. Both men were placed on three years of probation.

Obama pardons holiday turkeys, pokes fun at media (Reuters)

WASHINGTON (Reuters) ? It may not help the economy, but President Barack Obama found another move he can make without congressional approval on Wednesday: pardon a turkey.

Obama, a Democrat, has spent the last several weeks criticizing the Congress and Republicans for not embracing his jobs proposals, launching a "We Can't Wait" campaign to highlight executive actions he was taking to boost the economy without lawmakers' input.

With tongue in cheek, the president brought the same logic -- minus the economic incentive -- to the annual White House ritual of sparing a turkey.

Americans celebrate Thanksgiving on Thursday, and turkey is the centerpiece of the traditional holiday meal.

"Some of you may know that recently I've been taking a series of executive actions that don't require congressional approval," Obama told a chuckling crowd at the White House, with his daughters standing at his side.

"Well, here's another one. We can't wait to pardon these turkeys. Literally. Otherwise, they'd end up next to the mashed potatoes and stuffing."

Obama, grinning, raised his hand over one bird, dubbed "Liberty," and pronounced it safe from slaughter.

Obama said Liberty was chosen from a flock of 30 birds and raised by students from a high school in Minnesota, near the farm where the birds came from.

He used the occasion to poke fun at Washington and the media, saying Liberty and his feathered friend Peace, who was not visible, had been trained for an outing before the press.

"I'm told that in order to prepare Liberty and Peace for their big day, the students exposed them to loud noises and flash bulbs so that they'd be ready to face the White House press corps. This is actually true," he said.

"They also received the most important part of their media training, which involves learning how to gobble without really saying anything," Obama deadpanned.

Both birds will spend their remaining days living at Mount Vernon, the estate of the first U.S. president, George Washington.

"So Liberty is ready for his turn in the spotlight. And after he finishes a round of cable hits and a few Sunday shows, he's going to retire to a life of leisure at Mount Vernon -- the same place where George Washington spent his golden years," Obama joked.

Obama and his family later went to a local food bank. Before they left he said they would bring with them "two unnamed turkeys, who weren't so lucky."

Researchers develop method for advancing development of antipsychotic drugs

Wednesday, November 23, 2011

Researchers interested in the treatment of schizophrenia and dementia have clarified how antipsychotic drugs that target a complex of two receptors at the surface of cells in the brain work, according to a new study published online Nov. 23 in the journal Cell.

The multidisciplinary team included researchers from the Virginia Commonwealth University School of Medicine, together with the Mount Sinai School of Medicine in New York and the University of Maryland School of Pharmacy in Baltimore. In an earlier, but related study, the Mount Sinai School of Medicine team had shown that two brain receptors, which bind the critical neurotransmitter signals serotonin and glutamate at the outside of the cell, form a complex in the areas of the brain that malfunction in schizophrenic patients.

The team has now developed a metric that may help determine the effectiveness of antipsychotic drugs and advance drug design. The present work fills an important gap in knowledge as previously researchers did not understand how this receptor complex was connected to the phenotype of schizophrenia.

The current study findings show that the connection between the complex of the two receptors and the schizophrenic phenotype is a defect in how the serotonin and glutamate signals get interpreted at the inside of the cell, a process referred to as signaling. Moreover, it shows how antipsychotic drugs used to treat patients work to correct such a defect in the brain.

"Not only have we learned how antipsychotics drugs are effective, but we have also found that the signaling through this receptor complex is critical to how these anti-psychotics work," said the study's principal investigator Diomedes E. Logothetis, Ph.D., an internationally recognized leader in the study of ion channels and cell signaling mechanisms and chair of the VCU School of Medicine's Department of Physiology and Biophysics.

According to Logothetis, the most common cellular targets for drugs used in the clinic and by the pharmaceutical industry are G protein-coupled receptors, such as the ones that were examined in this study. Using cell and animal models, they found that the receptors signal very differently when they are together as a complex than when they are apart.

The metric developed by the team could be used to screen new drugs and determine their level of effectiveness, or be used to assess combination therapies - that is, putting two previously ineffective drugs together and making them more useful for some patients. Ultimately this work may translate to creating better antipsychotic drugs for patients.

"We can use the metric we developed to screen new drugs and determine their level of effectiveness," Logothetis said. "We can also use the metric to assess what combinations of existing drugs will give us the ideal balance between the signaling through the two receptors of the complex."

Logothetis said the hope is that by using this approach one day researchers will be able to develop a means by which high-throughput screening of drugs can be performed and they also will be able to develop more effective combinations of drugs that are able to help the third of schizophrenic patients who do not respond to current treatments.

Future studies will focus on further identifying the protein targets of the unique signaling pattern of this receptor complex and their link to schizophrenia.

The study was supported by grants from the National Institutes of Health.

The 5 surprising truths about senior pets | Pets Best Blog

A cat, that would benefit from cat insurance, sits on a table.

By: Chryssa Rich
For Pets Best Insurance

No one can deny the joy puppies and kittens bring. Even before I started working for a pet insurance company, I always loved animals. I can?t think of anything cuter than a tiny ball of fur running like crazy around the house and falling asleep in your arms. But most pet owners know how much work a young pet can be, and that?s why some adopt older pets instead.

When you hear the term ?senior pet?, you may think of a frail pet who is half blind and can hardly walk. But that?s not the case! In fact, cats and small breed dogs are considered seniors at just 9 years old, and larger breed dogs become seniors as early as age 6. My mother-daughter cats are 9 and 8, and they run, play, chase toys and snooze in the sun just like when they were younger.

Furthermore, there?s no reason to assume an older pet is damaged or defective in any way. They typically end up in shelters because their owners passed away, moved to a non-pet friendly rental, were deployed overseas, welcomed a new baby into the family, or even developed pet allergies.

Before Adopt a Senior Pet Month comes to an end, I encourage you to consider adopting an older pet the next time you?re looking to add to your family. Here are some advantages to doing so:

1. They?re Housebroken and Litter Box Trained
When you adopt an older pet, you almost never have to worry about housebreaking or litter box training. You?ll have fewer accidents to clean up and fewer lunch breaks demanding you to run home.

2. No Size Surprises
When you adopt a puppy, especially a mixed breed, it can be anyone?s guess how big he or she will get. With senior pets, what you see is what you get. There?s no chance that Lab mix you wanted for hunting will only grow to 20 pounds or that supposed Boxer mix will turn out to be a Mastiff mix.

3. They Let You Sleep
Kittens love to run through the house at night and wake you at 2 AM to play. Puppies being crate trained can whimper for hours and sometimes need a potty break in the middle of the night. All this can lead to quite a few sleepless weeks ? even more if your kitten is extra active or your puppy?s bladder takes a while to catch up with his body.

Or Call 866-929-3807 to Add a Pet to Your Current Policy

4. The Dangerous Curious Phase has Passed
Puppies and kittens explore their worlds and cure boredom with their mouths. This can mean frequent trips to the vet for things like foreign object ingestion and accidental poisoning, and both puppies and kittens have been known to destroy furniture, electrical cables and clothing by chewing. While pet health insurance can help with the costs of these vet trips, the number will likely be diminished if you adopt a more mature pet who is less curious.

5. They?re Less Demanding
Mature cats and dogs who have already bonded with humans are more likely to be content just hanging around the house with you. Senior dogs don?t need hours of play every day like younger dogs, and senior cats may be perfectly happy staying indoors and out of trouble.

As with any pet adoption, look into dog and cat insurance as soon as possible. The earlier coverage begins, the better the odds your pet will be protected before developing a pre-existing condition. Pets Best Insurance is one of the only pet insurance companies with no upper age limits for pets, and no canceled or reduced coverage based your pet?s age.

Mayor stages hunger strike as residents shiver (Reuters)

BUCHAREST (Reuters) ? A Romanian mayor has begun a hunger strike to protest against cuts in heating subsidies imposed under a government austerity drive, reawakening memories of the harsh final years of communism.

Mayor Florin Cazacu said 10,000 residents in the central Romanian town of Brad were braving low temperatures at home because his town hall lacked 3 million lei ($925,200)from the state budget to buy fuel oil for the winter season.

"People are suffering from cold, this is why I began this protest," Cazacu told Reuters. "I took an oath ... to do everything in my power and competence for the sake of the inhabitants."

During the last years of communist leader Nicolae Ceausescu heating was often shut down under an austerity drive aimed at repaying Romania's foreign debt.

This inflicted widespread suffering before Ceausescu's overthrow in 1989. Living standards have since risen sharply but winters remain tough for many Romanians.

The European Union's second poorest member state introduced tough austerity measures last year including salary cuts and a rise in value-added tax to one of the highest levels in the EU.

Romania has promised the International Monetary Fund, which is leading a 5 billion euro aid deal, to liberalize its gas and power markets, raise administered prices and scrap government subsidies for centralized heating.

Temperatures in winter fall as low as minus 30 Celsius degrees (-22 Fahrenheit) in the region around Brad, which has a total population of 17,000.

As apartments in Brad are not connected to mains gas, some people are using electric heaters but this has caused frequent power cuts due to town's poor electricity grid.

"I will stay on hunger strike for as long as it takes ... and give up the protest only if the government grants us the necessary funds," said 46-year-old Cazacu. ($1 = 3.2426 Romanian leus)

'Shame' NC-17 Rating: Could It Destigmatize Films Slapped With This Label?

By JAKE COYLE, The Associated Press

NEW YORK ? The NC-17 rated "Shame" poses an intriguing test for the much-lamented rating and stands a chance of being one of the most notable adults-only releases since "Last Tango in Paris" or "Midnight Cowboy."

When Steve McQueen's film about a sex addict (Michael Fassbender) arrives in theaters Dec. 2, it will have already found enthusiastic debate at film festivals, largely laudatory reviews and a significant presence in the Oscar race, where Fassbender is considered a top contender for a best actor nomination.

Though most films tagged by the Motion Pictures Association of America with an NC-17 rating either protest the decision or edit down to an R-rating, Fox Searchlight (which acquired "Shame" at the Toronto Film Festival) has accepted the NC-17 as fair.

"We're releasing it not because of (the rating), but perhaps in spite of it," says Stephen Gilula, co-president of Fox Searchlight. "We just think it's a film that deserves to be seen."

An NC-17 rating still poses challenges for "Shame" and Fox Searchlight, but some believe the stigma of the rating may be fading.

The rating, which restricts anyone under the age of 18 from attending a movie, was created in 1990 after the "X" rating (which the MPAA had failed to trademark) was co-opted by the pornography industry. Since then, the most successful NC-17 film at the box office has been 1995's "Showgirls," which earned $20.4 million and a great deal of scorn from critics.

On the whole, the rating has been taken by smaller, art-house films. Recent NC-17 releases have included Bernando Bertolucci's "The Dreamers" (2004, Fox Searchlight), Ang Lee's "Lust, Caution" (2007, Focus Features) and Pedro Almodovar's "Bad Education" (2004, Sony Pictures Classics).

Many more movies have received the rating and avoided it by recutting, reportedly including "Pulp Fiction," "Boys Don't Cry," "American Pie" and "Basic Instinct." Last year's "Blue Valentine" had its rating overturned after an appeal. Some films simply choose to instead go "unrated" rather than accept the NC-17.

"('Shame') is potentially an important step in the legitimate use of the NC-17," says John Fithian, president of the National Association of Theatre Owners. "There just aren't very many movies released in the NC-17 rating anymore. We get maybe one or two a year. Filmmakers and movie studios are inappropriately afraid of the rating."

Fithian says his association hopes to "eradicate the stigma" of NC-17, which he disputes. In surveying 100 theaters, the theater owners' group found that 97 would play a NC-17 film. He calls the assertion that NC-17 films are limited in their advertising a myth.

Advertising a NC-17 film on television is limited to certain hours. Most newspapers will accept ads for a NC-17 film as long as they're tasteful.

"What we currently have is a system that's slightly flawed in the reluctance of filmmakers and distributors to use the NC-17," Fithian says. "What they'll do is cut and trim and try to cram a movie into the R rating category so that it escapes the NC-17, and that's not a legitimate use of the system. We end up with a very broad R category."

Joan Graves, head of the movie ratings system for the MPAA, says the MPAA applies the NC-17 rating "much more often than it's accepted."

"I've always considered it a shame that for some reason some people consider it (a death sentence), and I blame the media in a way because they always act like it's gotten the kiss of death," says Graves. "But there isn't one of our ratings that means a film is good or bad."

Yet the media holds little sway over film producers who cut films to an R, or the movie theater chain Cinemark, one of the country's largest, which refuses to screen NC-17 rated films. Important retail stores such as Wal-Mart, too, don't stock NC-17 rated DVDs.

"There's a reason that studios and filmmakers do everything they can not to get an NC-17 rating," says Kirby Dick, whose 2006 documentary about the MPAA rating system "This Film Is Not Yet Rated" was ironically slapped with an NC-17 rating. "It's definitely an anchor. I don't think it's a death sentence, but I definitely think it does impact the marketability of a film ? not only because there are certain restrictions as to where it can be advertised and which theaters will take it, but also because the perception around the film then is purely as a sensational film."

Dick would like to see the MPAA and theater owners' association build a strong ad campaign around the NC-17 rating to improve its image, and until then, he's dubious of any stated intentions to change it. Graves says she's "open to suggestions."

For "Shame," Fox Searchlight is planning to open in five cities (New York, Los Angeles, Washington, San Francisco and Chicago), then expand to five more cities on Dec. 9 and ten more on Dec. 16.

"This is a film that's opening on a limited release basis to try to establish its reputation, get reviews and build on word-of-mouth," says Gilula. He anticipates it will play across the country, wherever there is a demand to see it.

Gilula acknowledges the rating will, by rule, reduce the size of the potential audience and may result in "some limitation" in DVD sales in retail chains, but that the film "will find its audience and vice versa."

Online advertising, which isn't subject to the same restrictions as other media, will play a big part. "Shame" is being prepped with a robust Internet and social media campaigns. Its trailers have been received enthusiastically online, where they've populated film blogs. (Amazon.com, too, will help "Shame" later in DVD sales.)

Paul Dergarabedian, box-office analyst for Hollywood.com, expects "Shame" to be "a big conversation piece" that will see high per-screen averages on release. Though he believes NC-17 is "a very limited and limiting rating," he believes it could have some upside.

"R-rated movies are a dime a dozen," says Dergarabedian. "If Fox Searchlight can harness the power of the NC-17, they can turn it into a plus."

Perhaps a stauncher challenge will lie with academy voters. "Midnight Cowboy," which won best picture as well as best director and adapted screenplay, is the only X-rated or NC-17 film to win an Oscar. That was in 1970, just months after then MPAA president Jack Valenti created the current ratings system, thereby overriding the restrictive Hays Code and replacing it with a guide for parents.

Even if it were an R-rated film, "Shame" wouldn't have an easy road to Oscar nominations, given the always crowded field. But NC-17 films have generally been avoided entirely by the academy.

"There's this thought that the academy is going to be too old-fashioned to embrace this picture," says Nancy Utley, Fox Searchlight's other president. "But Steve and I are both academy members, we're both over 50 and we both really have a strong appreciation for the movie. I have faith that the academy is more progressive than people give it credit for."

The ironic thing is that "Shame," for all its graphic nudity, isn't a sexy or titillating film. It's a film ultimately about a damaged and lonely man, punishing himself in sex-obsessed contemporary times.

"It's like a reality which is being thrown at you through the screen, and that screen becomes a mirror," says McQueen. "That's what I've always wanted to do with cinema: Make the screen a mirror. Often is the case with films and movies is you're seeing a movie reality rather than an actual reality. What I wanted to project on to the screen is an actual reality and I think that's why people are talking about it, not necessarily because of the sex."

Reaction to committee's failure to cut deficit (AP)

WASHINGTON ? Reaction to a special deficit-reduction supercommittee's failure to approve a plan that cuts at least $1.2 trillion in the coming decade:

___

"I would have anticipated that the president of the United States would have spent every day and many nights working with members of the supercommittee to try to find a way to bridge the gap, but instead he's been out doing other things, campaigning, blaming and traveling. This is, in my view, inexcusable." ? Former Massachusetts Gov. Mitt Romney.

___

"One way or another, we will be trimming the deficit by a total of at least $2.2 trillion over the next 10 years. That's going to happen, one way or another. We've got $1 trillion locked in, and either Congress comes up with $1.2 trillion, which so far they've failed to do, or the sequester kicks in and these automatic spending cuts will occur that bring in an additional $1.2 trillion." ? President Barack Obama.

___

"Despite the danger posed by sequestration, I join the president in his call for Congress to avoid an easy way out of this crisis. Congress cannot simply turn off the sequester mechanism, but instead must pass deficit reduction at least equal to the $1.2 trillion it was charged to pass under the Budget Control Act." ? Defense Secretary Leon Panetta.

___

"Manufacturers continue to be negatively affected by the rising debt crisis and its accompanying uncertainty and shaken consumer confidence. We are extremely disappointed that the Committee did not take advantage of the opportunity to restore confidence and stability to our economy by reforming entitlement programs and creating a tax code that promotes investment, growth and jobs." ? National Association of Manufacturers President and CEO Jay Timmons.

___

"The American people are tired of their elected leaders listening to the extreme voices in their party instead of the voices of reason. I am disappointed that Republicans never found the courage to ignore Tea Party extremists and millionaire lobbyists like Grover Norquist, and listen instead to the overwhelming majority of Americans - including the vast majority of Republicans - who want a balanced approach to deficit reduction." ? Senate Majority Leader Harry Reid, D-Nev.

___

"They were trying to break out of the mess by being, in my judgment, even dumber ? that is, creating a committee of 12 picked by the political leadership to magically get in a room to come up with something that 535 couldn't solve." ? Former House Speaker Newt Gingrich.

___

"Unfortunately, this opportunity has been wasted." ? U.S. Sen. Pat Toomey, R-Pa.

Gates testifies in $1B lawsuit against Microsoft

(AP) ? Microsoft's Windows 95 rollout presented the most challenges in the company's history, leading to several last-minute changes to technical features that would no longer support a rival software maker's word processor, Bill Gates testified Monday in a $1 billion antitrust lawsuit filed by the former owner of WordPerfect.

"We worked super hard," the Microsoft co-founder said. "It was the most challenging, trying project we had ever done."

Gates was the first witness to testify Monday as Microsoft lawyers presented their case in the trial that's been ongoing in federal court in Salt Lake City for about a month. He is set to resume testimony Tuesday morning.

Utah-based Novell Inc. sued Microsoft in 2004, claiming the Redmond, Wash., company violated U.S. antitrust laws through its arrangements with other software makers when it launched Windows 95. Novell says it was later forced to sell WordPerfect for a $1.2 billion loss. Novell is now a wholly owned subsidiary of The Attachmate Group, the result of a merger that was completed earlier this year.

Gates said Novell just couldn't deliver a Windows 95 compatible WordPerfect program in time for its rollout, and its own Word program was actually better. He said that by 1994, Microsoft's Word writing program was ranked No. 1 in the market above WordPerfect.

Gates called it an "important win."

He testified later that Microsoft had to dump a technical feature that would have supported WordPerfect because he feared it would crash the operating system.

"We were making trade-offs," he said.

Novell argues that Gates ordered Microsoft engineers to reject WordPerfect as a Windows 95 word processing application because he feared it was too good.

WordPerfect once had nearly 50 percent of the market for computer writing programs, but its share quickly plummeted to less than 10 percent as Microsoft's own office programs took hold.

Microsoft lawyers say Novell's loss of market share was its own doing because the company didn't develop a Windows compatible WordPerfect program until months after the operating system's rollout.

Novell attorney Jeff Johnson has conceded that Microsoft was under no legal obligation to provide advance access to Windows 95 so Novell could prepare a compatible version. Microsoft, however, enticed Novell to work on a version, only to withdraw support months before Windows 95 hit the market, he said.

Microsoft lawyer David Tulchin said Gates decided against installing WordPerfect because it couldn't be made compatible in time for the rollout. He argued that Novell's missed opportunity was its own fault, and that Microsoft had no obligation to give a competitor a leg up.

"Novell never complained to Microsoft," Tulchin said during arguments Friday. "There's nothing in the evidence, no documents."

Johnson maintains Novell was tricked in violation of federal antitrust laws so Microsoft could monopolize the market.

"We got stabbed in the back," he said.

Microsoft's arguments for a dismissal of the case resumed Monday afternoon.

Throughout arguments Friday, U.S. District Judge Frederick Motz openly expressed doubts that Novell's claims had merit.

"I don't see why I have to give a product to a competitor so he can beat me," Motz told Novell attorneys.

Gates, a billionaire, began by testifying about Microsoft's history. He was just 19 when he helped found the company. Today, Microsoft is one of the world's largest software makers, with a market value of more than $210 billion.

"We thought everybody would have a personal computer on every desk and in every home," Gates said. "We wanted to be there and be the first."

Pit bulls can make good pets - Kris Weiskopf - BradentonHerald.com

Talking about myths, these are important to us because they hit home at Animal Services. A lot of misconceptions surround pit bulls that need clarification. Everyone needs to keep an open mind, visit our shelter and look for yourself before discounting a type of dog, just because of what you may have heard.

To believe that pit bull dogs are aggressive toward people is wrong. Pit bulls are actually less aggressive toward people than many other breeds. Like any dog, pit bulls are shaped by their environment and without proper socialization and training, they can be encouraged to show aggressiveness toward people.

Beyond a dog?s breed, several factors affect a dog?s tendency toward aggression including their reproductive status, sex and early experience with socialization and training. It has been found that the majority of dog bite cases involve unneutered male dogs. An unneutered male dog is more than twice as likely to bite than a neutered male.

A chained or tethered dog is also more than twice as likely to bite than a dog that is not chained or tethered.

Pit bulls will attack without warning is another myth. No dog, including a pit bull, is going to transform from a docile, gentle companion to a ferocious beast without warning.

There are always warning signs that a dog is aroused, upset or afraid. The issue is not that pit bulls attack without warning. It?s that people often don?t recognize or pay attention to the warning signs.

It has been said that it is not safe to adopt a pit bull from a shelter because its past is not known. Even though it is always helpful for us to have some idea of past medical and behavioral history, this is not the case much too often. A shelter dog?s past is usually a mystery. We encourage you to bring your entire family, including your current pet, to meet the new dog. We do our best to help you find a ?best fit? for your family.

Pit bulls are dogs that deserve respect and appreciation. They deserve to be understood. It is not uncommon that comments are made by the visitors to our shelter that all we seem to have is pit bulls. These same people comment they would never own one because they are vicious. The wheels kick in and staff go beyond to dispel these myths.

Most people have come to the conclusion that all pit bulls are bad, no matter, except those who actually have a pit bull dog for a pet. Regardless of any facts, it seems people have formed their own opinions about pit bulls, which is a sad statistic of stereotyping and profiling. People often do not base their comments on facts, just biased opinions.

Pit bulls come in all different colors, shapes and sizes. I challenge all of you looking for a dog, to visit Animal Services and give a pit bull dog a chance. They at least deserve that.

Adopt your new family member from Manatee County Animal Services today. Don?t forget about our November adoption special. We have falling prices. Adopt any dog or cat for 30 percent off the regular adoption fee. Dogs are $56 and cats are $42 this month which includes the required license certificate and tag. A microchip is also included!
